The short version: The Employment Pack Builder is a document tool. It produces general-information templates from the answers you give it. It is not legal advice, we are not a law firm, and you're responsible for checking the documents suit your business and your employee before anyone signs. If you need legal certainty, speak to an employment lawyer.

Terms of Use

1. Agreeing to these terms

By buying access to, or using, the Employment Pack Builder (the "Builder"), you agree to these Terms of Use, the Refund Policy and the Privacy Policy on this page. If you are using the Builder for a business, you confirm you are authorised to accept these terms on its behalf.

2. What the Builder is, and isn't

  • The Builder is a self-service tool. It assembles employment documents, such as offer letters, employment agreements, child safe policies and forms, from standard templates based on the answers you enter.
  • The documents are general information and templates only. They are not legal, employment, HR, tax, superannuation or financial advice. They are not tailored advice about your circumstances, and they have not been reviewed by a lawyer for your situation.
  • Using the Builder does not create a lawyer–client, adviser or fiduciary relationship between you and us.
  • The Builder can't know everything about your business, your employee or your arrangements. It relies entirely on the information you provide.
  • The templates are written for martial arts, dance and similar schools whose staff are covered by the Fitness Industry Award 2020. They are not designed for roles covered by a different award or an enterprise agreement, or for award-free roles.

3. Your responsibilities

You are responsible for:

  • giving accurate and complete answers
  • deciding whether the Fitness Industry Award 2020 covers your business and the role, and choosing the correct classification, employment type and pay for your employee (see section 3A)
  • reading and checking every document before you use it, and editing it where needed
  • downloading and giving your employee the current official documents required by law, including the Fair Work Information Statement, the Casual Employment Information Statement (for casuals), and the ATO superannuation and tax file number forms
  • complying with all workplace, child safety, child employment, privacy and other laws that apply to you, including obtaining any required clearances, licences or permits
  • keeping your pay rates and documents up to date when laws, awards or your employee's circumstances change
  • getting your own professional advice where you need certainty

3A. Awards, classifications and other choices you make

  • The Builder does not decide which award applies to your business or to a particular role. Before building a pack, you must confirm that the Fitness Industry Award 2020 covers the role, for example using the Fair Work Ombudsman's Find my award tool (fairwork.gov.au) or by getting advice. You confirm this each time you build a pack, and we keep a record of that confirmation.
  • Tools such as "Help me choose a level", suggested duties, warnings and default wording are guides only. You decide the final classification, employment type, hours and pay rate.
  • If another award or an enterprise agreement applies, or the role is award-free, the documents may be wrong for that role. You must not use them for that role without professional advice.
  • To the maximum extent permitted by law, we are not responsible for any loss or claim that results from the award, classification, employment type, hours, pay rate or other answers you choose or enter.

4. Accuracy and currency

We take reasonable care to keep the Builder's rates and rules current. We check them at the date shown in the Builder and update them at least once a year after the Fair Work Commission's Annual Wage Review. However, laws, awards and government requirements change, sometimes without notice. We don't guarantee that the Builder or any document is complete, error-free, current or suitable for your purposes. Always confirm pay rates with the Fair Work Ombudsman's Pay and Conditions Tool (calculate.fairwork.gov.au).

5. Plans and access

  • Single Pack: one employment pack for one employee.
  • Growth: up to 10 packs in each 12-month subscription period. Unused packs don't carry over.
  • Unlimited: unlimited packs during the subscription period, subject to fair use.
  • Access is for your own business, including other locations of the same business. You must not share your access link, resell the Builder, or use it to create documents for other businesses as a service.
  • We may suspend access if we reasonably believe these terms have been breached.
  • We may give some organisations free or discounted access at our discretion.
  • Your access link is personal to your business. The number of packs on your plan is tracked against it, and rebuilding a pack you've already made (using the same answers) doesn't use another pack.

6. Payment, renewal and cancellation

  • Prices are in Australian dollars and include GST where applicable.
  • Payments are processed by our payment provider. We don't see or store your full card details.
  • Growth and Unlimited are annual subscriptions that renew automatically each year until cancelled. We'll email you before renewal.
  • You can cancel at any time by emailing [email protected]. Cancellation stops the next renewal, and your access continues until the end of the period you've paid for.
  • Free first year offers: where we offer a plan free for the first 12 months (for example as a bonus with another Martial Arts Mentors program), the price and renewal date are shown at checkout. Unless you cancel before the free period ends, the plan renews automatically at the price shown. We'll email you before the first payment is taken.

6A. Founding-member release

The Builder is currently a founding-member release. We are arranging an independent review of our master templates by an Australian employment lawyer. When the review is complete, we'll update the templates. Packs you build after that use the updated templates automatically. If the review leads to a material change, we'll email you, and you can rebuild packs you've already made with your original answers at no extra cost. Until then, the general-information notice in section 3 applies in full.

7. Your documents and our content

Once you have paid, you may use, copy and edit the documents you generate for your own business and employees. We (or our licensors) own the Builder, its templates, wording, design and software. You may not copy, extract or redistribute the templates or Builder content, except as part of documents you generate for your own use.

8. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law:

  • We exclude all conditions, warranties and guarantees that are not expressly set out in these terms.
  • We are not liable for any loss or damage arising from your use of, or reliance on, the Builder or any document it produces. This includes underpayment claims, back-pay, penalties, fines, disputes, claims by employees or third parties, and loss of profit, revenue, data or opportunity. It also includes any indirect or consequential loss, and any loss that results from the award, classification, employment type, hours or pay you selected, or from inaccurate or incomplete answers.
  • Where our liability cannot be excluded but can be limited, it is limited, at our option, to supplying the service again or paying the cost of having it supplied again.
  • Otherwise, our total liability to you is limited to the amount you paid us for the Builder in the 12 months before the claim arose.

9A. Claims about your employees

You are the employer, and you are responsible for your employees' employment. If one of your employees, a regulator or another third party makes a claim against us about a document you generated or used, you agree to cover our reasonable losses and costs to the extent the claim arises from your answers or choices in the Builder, your use or editing of the documents, or your breach of these terms or the law. This doesn't apply to the extent the claim is caused by our own negligence or breach of these terms.

10. Changes

We may update the Builder and these terms from time to time. The version shown on this page applies from the date it is published. If a change materially reduces your rights during a paid subscription, you may cancel and ask for a pro-rata refund of the unused period.

11. General

These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that state. If any part of these terms is unenforceable, the rest continues to apply.

Refund Policy

  • Australian Consumer Law: if the Builder has a major failure, or doesn't meet a consumer guarantee, you're entitled to a remedy under the Australian Consumer Law, regardless of anything below.
  • Single Pack: if you haven't generated your pack within 14 days of purchase, you can ask for a full refund.
  • Growth or Unlimited: you can cancel within 14 days of your first purchase, or of a renewal, for a full refund of that payment, provided no more than one pack was generated in that period.
  • Outside these situations, we don't offer refunds for change of mind once packs have been generated, because the documents have already been delivered.
  • To request a refund, email [email protected] with your order email and pack reference.

Privacy Policy

1. Our commitment

We handle personal information in line with the Australian Privacy Principles.

2. What we collect

  • About you (the buyer): your name, email, business name and details, state, purchase and subscription details, and records of which packs you've generated and when. We also record your acceptance of these terms.
  • Payments: processed by our payment provider (Stripe). We receive confirmation of payment, not your full card details.
  • About the pack: when you generate a pack, we receive a summary so we can email it to you and send reminders. The summary contains the employee's name, employment type, award level, whether they're under 18, start date, pay rate, key review dates and any warnings.
  • Optional reminders: if you tick "remind me", we also store the employee's first name, date of birth, start date, award level, employment type and state. We use these only to send you pay-rise and review reminders. You can turn reminders off and ask us to delete this information at any time.
  • Optional course invitation: if you tick the free course option, we receive the employee's email (and a parent or guardian's email if they're under 18). We use it only to invite them to, and give them access to, the Child Safety Staff Training course.
  • What we don't receive: the documents themselves are built in your web browser. Unless you choose the optional extras above, we don't receive or store your employee's date of birth or contact details. We never receive their address, bank, tax, medical or emergency contact details, except as encoded in the re-download link described below.
  • Your re-download link: to let you rebuild your pack later, we email you a link that contains your answers in encoded form. A copy of that email is kept in our email and CRM system (GoHighLevel). Anyone with the link can rebuild the pack, so please keep it private.
  • On your device: the Builder may save your business and child safety details in your browser, so you don't have to retype them next time. You can clear this at any time by clearing your browser's site data.

3. How we use it

We use this information to:

  • provide and deliver the Builder
  • manage your account and plan
  • send your pack, pay-rise and review reminders, and important updates (for example when award rates change)
  • respond to support requests
  • improve the Builder
  • with your consent, or where the law allows it, tell you about other Martial Arts Mentors services. You can unsubscribe at any time.

4. Who we share it with

  • We don't sell personal information.
  • We share it only with service providers who help us run the Builder: our CRM and email platform (GoHighLevel/LeadConnector), our payment provider (Stripe) and hosting providers. We also share it where the law requires.
  • Some of these providers store data outside Australia, including in the United States.

5. Your employees' information

When you enter information about your employee, you are responsible for collecting and using it lawfully, and for telling them how their information is handled in your business.

6. Security and retention

We take reasonable steps to protect personal information from misuse, loss and unauthorised access. We keep it only for as long as we need it for the purposes above, or as the law requires.

7. Access, correction and complaints

You can ask to access or correct your personal information, or make a privacy complaint, by emailing [email protected]. We'll respond within 30 days. If you're not satisfied, you can contact the Office of the Australian Information Commissioner (oaic.gov.au, 1300 363 992).
